You can apply for Same-Sex Partner visa entry clearance online if you are a same-sex partner of a British citizen or settled person and resident outside the UK. If the applicant meets the requirements for entry clearance as a same-sex partner of the British Citizen or settled person, he/she will be granted entry clearance for an initial period not exceeding 33 months, and subject to a condition of no recourse to the public funds.

Overview

A couple needs to demonstrate that they have lived together for a period of at least two years in order to apply for a Same-Sex Partner visa UK. This can be cohabitation in the UK, abroad, or a mixture of both.

An application for same-sex partner visa entry clearance from outside the UK is made online. Upon completion and submission of the online form for same-sex partner visa entry clearance UK, the same-sex partner visa entry clearance fee and Immigration Health Surcharge (IHS) is paid online. All the supporting documents in support of the same-sex partner visa application are then uploaded online. An appointment is then booked with the UK visa Application Centre for the enrolment of biometrics and submission of the Applicant's passport at the designated UK visa application centre in the country of residence of the applicant.

Requirements for Same-Sex Partner Visa UK

The applicant applying for entry clearance as a same-sex partner of a British Citizen or a person settled person must meet the following requirements:

  • Suitability criteria as set out in Appendix FM to the Immigration Rules;
  • Must have been living together with the UK sponsor for at least 2 years in a relationship akin to civil partnership or marriage;
  • Genuine and subsisting relationship as a same-sex partner of a person present and settled in the UK;
  • Financial requirement whereby the UK sponsor of the applicant must be earning at least £18,600 gross per year or savings of £62,500 if the UK sponsor of the applicant has no earnings from employment, self-employment, or other means of income;
  • Adequate accommodation for the applicant and the UK sponsor to be accommodated in the UK without recourse to public funds;
  • English language requirement to show that the applicant has English proficiency at CEFR level A1 as required by the UK Immigration Rules.

Switching to Same-Sex Partner Visa UK

Switching to Same-Sex Partner visa (5 years route)

You can apply for switching into a Same-Sex Partner visa on the basis of your same-sex cohabiting relationship of 2 years with a British Citizen or a person present and settled in the UK. The Same-Sex Partner visa application will be considered in accordance with the requirements of the Immigration Rules as set out in Appendix FM of the Immigration Rules. If you meet all the requirements as set out in Appendix FM of the Immigration Rules, you will be granted 30 months (2.5 years) leave to remain under the 5 years route to settlement. Those applicants who cannot meet all the requirements for switching into a Same-Sex Partner visa under 5 years route, can apply for switching to a Same-Sex Partner visa (10 years route).

Switching to Same-Sex Partner Visa UK Under 10 Year Route

You can apply for switching into Same-Sex Partner visa under 10 years route if you are in the UK and you are a same-sex partner of a British Citizen or a settled person and you cannot meet all the requirements of the Appendix FM for switching into Same-Sex Partner visa under 5 years route. Application for leave to remain as a same-sex partner under 10 years route is usually made by those applicants who cannot meet the financial requirement, immigration status requirement, or English language requirement. An application for a Same-Sex Partner visa under the 10 years route is made using the online application form FLR (FP).

Extension of Same-Sex Partner Visa UK

Extension of Same-Sex Partner Visa UK Under 5 Year Route

You can apply for renewal of your Same-Sex Partner visa under 5 years route from inside the UK by using the application form FLR (M) online prior to the expiry of your initial leave of 2.5 years. As a result of a successful application for extension of your Same-Sex Partner visa under 5 years route, you will be granted further leave to remain for 30 months (2.5 years) to be able to complete 5 years in the UK and thus apply for ILR as a same-sex partner under 5 years route. An application for Same-Sex Partner visa renewal will be considered in accordance with the requirements of the Immigration Rules as set out in Appendix FM of the Immigration Rules.

Extension of Same-Sex Partner Visa UK Under 10 Year Route

You can apply for an extension of your Same-Sex Partner visa under 10 years route from inside the UK if you are already in the UK on a Same-Sex Partner visa under the 10 years route. The application for Same-Sex Partner visa renewal under the 10 years route is made using an online application form FLR (FP). The applicants applying for renewal of Same-Sex Partner visa under 10 years route are not required to meet the financial requirement of earning £18,600 gross per year and the English language requirement.
